Withdrawal Information

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party nominated by you who is not the carrier, takes possession of the last goods.

To exercise your right of withdrawal, you must inform us (Nertas – proprietor Jakob Schütz, Gleiwitzer Str. 35, 91058 Erlangen, Germany, info@nertas.com, telephone: +491758702891) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we receive the communication of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You shall send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal does not apply to the following contracts:

  • Contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly personalised.

Special notes
If you finance this contract by means of a loan and later withdraw from it, you will no longer be bound by the loan agreement either, provided that both agreements form an economic unit. This is to be assumed in particular if we are also your lender or if your lender uses our involvement with regard to the financing. If the loan has already been paid to us when the withdrawal takes effect, your lender shall, as between you and the lender, assume our rights and obligations arising from the financed contract with regard to the legal consequences of the withdrawal or return. This does not apply if the present contract relates to the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives).

If you wish to avoid a contractual commitment as far as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you also have a right of withdrawal in respect of that agreement.
